Welcome to CapyUp. These Terms of Use (the "Terms") apply to your access to and use of the CapyUp mobile application, website, content, features, and related services (collectively, the "Services"). The Services are provided by CapyUp ("CapyUp," "we," "us," or "our").

Please read these Terms carefully before using the Services. By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

1. The Services

CapyUp is designed to help users reduce prolonged sitting and build gentle stand-up habits. Depending on the features you choose to use, the Services may include:

• sitting timers, stand-up reminders, local notifications, and follow-up reminders;
• manual stand-up or "CapyUp rescue" records;
• optional smart detection using limited Apple Health data, such as step count and stand time, to help infer whether you may have stood up;
• local reports, trends, cards, achievements, and similar features based on your records;
• CapyUp Plus or other paid features;
• other related features we may provide from time to time.

We may update, modify, suspend, or discontinue any part of the Services for product, technical, safety, business, or legal reasons. Some features may vary by device, operating system, region, language, app store, or availability of third-party services.

2. Health and Safety Disclaimer

CapyUp provides general wellness, habit-building, and lifestyle support information only. The Services are not medical advice, diagnosis, treatment, rehabilitation guidance, or professional healthcare services. You should not rely on CapyUp reminders, reports, smart detection, or other content as a substitute for advice from a physician or qualified professional.

If you have a medical condition, pain, dizziness, fatigue, mobility limitation, pregnancy-related condition, or any other health concern, consult a qualified professional before changing your activity habits. If you are experiencing a medical emergency, contact your local emergency number immediately.

You understand that CapyUp reminders and smart detection may be inaccurate, delayed, incomplete, or unavailable. For example, device settings, missing sensor data, Apple Health permissions, operating system limits, notification settings, or device use patterns may affect the Services. You are responsible for deciding whether standing, walking, stretching, or any activity is appropriate for your body and environment.

3. Accounts and Eligibility

Some features may require an account, Apple ID, app store account, or other necessary information. You agree to provide accurate and complete information and to keep your account, device, and login credentials secure.

Unless applicable law requires otherwise, the Services are intended for users who are at least 13 years old or have reached the minimum digital consent age in their jurisdiction. Minors should use the Services only with the consent and guidance of a parent or legal guardian. We may restrict certain features for minors where required by law.
